What Is a Notary Witness?
Oregon law requires official witnessed signatures for certain legal documents. A licensed notary public serving as witness provides the highest level of credibility and legal validity.
Definition
A notary witness is a licensed notary public who serves as an official, impartial witness to the signing of legal documents.
The Notary Witness Confirms
Identity of all signing parties
Government-issued photo ID verified for every signer.
Voluntary signing
Each party signs willingly and without coercion.
Mental capacity
Signers appear to understand what they are signing.
Official seal & signature applied
Certifying the witnessed signing as a licensed notary public.
Notary Witness vs. Notarization
These terms are related but distinct. Understanding the difference matters for legal documents:
Notary as Witness
The notary observes the signing and attests to it as an official witness. Used for wills, POAs, real estate, and business agreements.
Standard Notarization
The notary verifies the signer’s identity and acknowledges their signature but does not need to observe the actual signing in real time.
